Glossary
The terms your European buyer is going to bring up, in plain language. Alphabetical order.
For the full context, read the GuideA
- Annex I ES: Anexo I
List of products and tariff codes covered by the regulation. If your product has no code in Annex I, the regulation does not apply. Some codes apply only in part ("ex"), so check the code, not just the product name.
- Authorized representative ES: Representante autorizado
Whoever submits the DDS on behalf of an operator established outside the EU, under a written mandate. It must be established in the EU.
C
- Cut-off date ES: Fecha de corte
31 December 2020. The land cannot have been deforested after that day for the product to comply.
D
- DDS (due diligence statement) ES: Declaración de diligencia debida
Electronic document that the operator submits before placing the product on the EU market. It declares that due diligence was carried out and that no risk, or only negligible risk, was found. It is registered in the European Commission's information system.
- DDS reference number ES: Número de referencia de la DDS
Number that the information system assigns to each DDS when it is registered. The operator communicates it to its buyers, and customs uses it when clearing the product.
- Deforestation ES: Deforestación
Conversion of forest to agricultural use, whether caused by humans or not. A product whose land was deforested after 31 December 2020 cannot enter the EU.
- Due diligence ES: Diligencia debida
The process of gathering information, assessing risk and reducing it before selling the product in the EU. A certification alone does not complete it.
E
- EORI ES: EORI
Economic operator registration number with the EU customs authority. The DDS asks for it when products enter or leave the European market. An operator outside the EU can only enter the system with a valid EORI from a Member State.
- EUDR ES: EUDR
Regulation (EU) 2023/1115 on deforestation-free products. It applies to seven commodities and to the products in Annex I. It is the rule your buyer must comply with if it places the product on the EU market.
F
- Forest ES: Bosque
Land of more than 0.5 hectares, with trees taller than 5 meters and canopy cover above 10%, except land with predominantly agricultural or urban use. Agroforestry systems, such as shade-grown coffee, fall outside the definition of forest.
G
- Geolocation ES: Geolocalización
Latitude and longitude coordinates, with at least six decimal places, that locate each plot. It is the base data: without it, you cannot verify that the land was not deforested. Shape: point, or polygon if the plot is larger than 4 hectares.
I
- Information system ES: Sistema de información
The European Commission's central database where DDSs are recorded. It is accessed through the Commission's TRACES platform.
L
- Legality ES: Legalidad
The production complies with the laws of the country where it was produced, in areas such as land use, environment, tax, labor rights and the rights of indigenous peoples.
M
- Mass balance ES: Balance de masas
Mixing product from different origins and declaring a proportion, instead of physically separating the lots.
O
- Operator ES: Operador
Whoever places a product on the EU market for the first time, or exports it from the EU. It is the one that submits the DDS, usually the importer. If your buyer is the operator, it will ask you for the data on each plot. Shape: line.
P
- Plot of land ES: Parcela
Land within a single property, recognized by the law of the country of production, with conditions homogeneous enough to assess deforestation risk. Each plot has its own geolocation.
- Polygon ES: Polígono
Closed figure that traces the exact outline of a plot by joining several points. Mandatory for plots larger than 4 hectares, except for cattle. Shape: plane.
R
- Risk assessment ES: Análisis de riesgo
The operator's assessment of whether a product could come from deforested land or have been produced illegally. Based on that assessment, it decides which data to request and whether it needs additional measures.
S
- Standard risk ES: Riesgo estándar
The level the EU assigns to countries that are not on the low-risk or high-risk list. Mexico has standard risk. It means the importer must carry out the full risk assessment and risk mitigation.
T
- Trader ES: Comerciante
Any actor in the chain, other than the operator and the downstream operator, that makes the product available on the EU market. It does not submit the DDS, but must keep the data of its suppliers and customers.
